Many times, we hear from fans who are upset or angry that someone is selling something on eBay that he or she shouldn't be selling. It might be a bootleg, illegal copy, or fan club CD.
Reminder on the fan club CD policy: You MAY resell only your original CD (no copies) but ONLY to another fan club member (get proof!) and ONLY for the price you paid (no making money on the fan club). This means you cannot auction a fan club item since the price will go above what you paid. Best to sell these privately here and make sure your buyer is a club member. Sometimes, the best way to get items taken down off eBay is to report them. Here is how to report items on eBay. 1) http://pages.ebay.com/help/contact_us/_base/index_selection.html is where you start. You would choose Listing Violation since bootlegs ARE against eBay rules. 2) Next, choose Counterfeits & Copyrights Violations. Then pick Bootlegs & Counterfeit Media. 3) What you pick in the next box will depend on what it is. Did someone burn their own mix CD or copy a record company release? You will probably want to choose Media on Recordable Formats. Is someone selling a fan club CD or something recorded live but never widely released by a record company? I'd choose Copies of Unreleased Movies. 4) The next screen will give you a link to eBay's policy on these items. You don't need to read that if you already know it! You can go straight to "EMAIL US." 5) NOW you're turning something in. You don't get to explain anything. You only get to type in item numbers. So maybe have those items ready in another window or write down the item numbers. Then, send those in. The more complaints they get, the more likely it is to come down. So if you see something really wrong, don't wait for everybody else to act. You will want to act TOO. |

There is actually a different way to do it. Or maybe it's different on the UK and USA versions of eBay.
1) Click on 'Help' and type 'prohibited item' into the search box. 2) Choose 'Prohibited and Restricted Items : Overview' 3) Choose 'Bootleg recordings' 4) At the bottom of that page choose 'Contact Customer Support, Report breaches of eBay policy or problems with another eBay member' 5) This is where you enter the item number(s), and you also get to explain why you are reporting the item. Also note that many eBay pages at the very bottom have a text link to REPORT THIS ITEM. That is even faster!

I was told that you could sell fan club cds, for more than face, but you will lose your membership.
The fan club cds are not bootlegs, how can they be pulled? |

Some fanclub cds are now being sold with the priviso that they are not sold on Ebay under any circumstances.
They are not generally released recordings - the agreement with artists/publishers etc is that they are only available to fan club members. If they are available to anyone via Ebay, there is a huge risk that they will stop being made, and it also breeches the agreement with the artists etc. sylcar |

I have one from John Hiatt that I bought via A&M Recs. in 1993 and it still sells on ebay for over $125.00. It is not a bootleg.
Bottom line is, you can't tell people what to do with them once they are bought. If the upcoming Crowded House shows are anything like the recent Police shows, and if the Police had fan club cds, I'd be dumping them on ebay as we speak. Stay tuned, eh? |
